Title II universal service obligation could bolster cities' case in Verizon FiOS buildouts

Like NYC, Pittsburgh Claims Verizon Didn't Meet FiOS Promises | DSLReports, ISP Information: While Verizon long-ago froze further FiOS deployments, the company did strike sweetheart deals with numerous east coast cities that gave the city a citywide franchise and numerous tax benefits, in exchange for the promise of full city FiOS coverage. But as we noted at the time, most of those agreements came with fine print that allowed Verizon lawyers to wiggle over, under, and around any uniform fiber deployment obligations. Shockingly, cities like New York City are now thinking about suing the telco for missing deployment promises.

You can add Pittsburgh to the list of cities who believe they were swindled by Verizon. Pittsburgh Mayor Bill Peduto has, several years later, started noting huge coverage gaps in the city's FiOS coverage. Peduto was one of 14 Mayors that recently wrote a letter to Verizon begging the company to upgrade its lagging DSL networks.

The U.S Federal Communication's Commission recently promulgated regulations classifying Internet as a common carrier telecommunications service and subject to universal service obligations under Title II of the Communications Act could strengthen the cities' case against Verizon. Local governments have successfully asked the FCC to intervene on their behalf when legacy incumbent providers used state laws to bar municipalities from building their own fiber telecom infrastructure. They could do so in this instance as well in a major test of the FCC's willingness to hold big incumbents accountable under its new rules.

Verizon CEO wrongly compares Internet usage to basic utility consumption

Internet Service Cost: Verizon CEO says heavy broadband users pay more | BGR: Are you constantly streaming high-definition video, downloading tons of Xbox One games and sending massive files to friends and family? You should pay more for Internet access than your neighbor, who only uses a 10-year-old PC in his living room to read email and occasionally browse the Internet for cat GIFs. This is the position of Verizon CEO Lowell McAdam, who said this week that heavy broadband users should have to pay more for home Internet access than those who don’t take full advantage of the service for which they already pay top dollar.



McAdam's logic would make sense if an Internet service was like that of other utilities such as electric power, water or natural gas. These are limited commodities that require some incentive to conserve their use so that they may be available to all who need them. That's why these utility providers use tiered billing schemes that tap into price elasticity -- the tendency to use less of a commodity as its price increases -- and create incentive to conserve via penalties for excessive consumption. There is no similar need to conserve Internet bandwidth. Someone who uses more of it does not impose higher marginal costs on Verizon or any other Internet provider to deliver that higher level of usage.

That said, McAdam is correct to expect that customers of its FiOS fiber to the premise service to help offset the capital and operating costs of the service. But treating bandwidth as a limited commodity when in fact it is not isn't the way to go about it. Instead of creating a false paradigm of bandwidth scarcity, McAdam and other industry leaders should endeavor to foster a mindset of bandwidth plentitude. Big bandwidth promotes more uses and applications of it, making it more valuable to households and businesses. And as those users realize that value, demand for fiber connections will grow, in turn increasing the value of the network under Metcalfe's Law and Verizon's investment in it. When it comes to the Internet, more is better -- not less.  What Verizon and other telecommunications companies should remember is they are not in the business of bundling and selling bandwidth. They are in the communications business.

The rainbow rabbit leaps over incumbents: Google Fiber in diligence for expansion in 9 metro areas of U.S.


Google Fiber's announcement today that it is in diligence with local governments in nine metro areas of the United States for possible expansion of its proprietary fiber to the premise (FTTP) telecommunications infrastructure illustrates how a company that has been in the Internet business from the beginning can nimbly hop over legacy incumbent telephone and cable companies. The incumbents are weighed down by large investments in metal wire-based infrastructure and outmoded pricing structures that rely on creating artificial bandwidth scarcity and unit-based consumption. They must also satisfy shareholders who favor big dividends over capital investment in FTTP networks -- which explains why Verizon halted its FiOS FTTP product expansion in 2012. Finally, incumbents have sowed sour relationships with local governments that have asked for better service for their residents for years, making them likely to heartily welcome the Googlers.

What's also evident from today's announcement is Google Fiber's colorful hare won't likely be running to areas of the U.S. where it's needed most -- locales where homes and businesses lack wireline premises Internet service due to redlining by the incumbent providers.

Those areas will likely have to rely on municipal and cooperative fiber builds, although some investor-owned players could potentially offer them FTTP as in this rather counterintuitive circumstance in Mississippi. They can, however, benefit from Google Fiber's experience, adopting principles and techniques that lower costs and improve the economics of FTTP. These include prioritizing construction based on interest from potential subscribers and differential pricing models that include an option for basic, flat rate service at low cost for a limited period of time.

Verizon CEO hints at fiber partnerships with local providers

Verizon, which halted build out of its FiOS fiber to the premise (FTTP) infrastructure last year, will stay that course Verizon CEO and Chairman Lowell McAdam said at last week's UBS Global Media and Communications Conference.  McAdam said some "fringe" deployment may occur, but that "deploying fiber in a lot of new markets isn't in the cards."

However, "I think there are more opportunities to partner out of market with companies that are there versus us going in and deploying FiOS," McAdam added.

McAdam's remarks were reported by Fierce Telecom

Verizon spokesman Bob Varettoni declined to elaborate on McAdam's comments when asked specifically with whom Verizon might partner to build FTTP infrastructure beyond its current footprint.

This development makes it eminently clear that for those communities in Verizon's wireline service area that don't now have its FiOS fiber to the premises service, they will have to build their own community owned infrastructure.  Verizon is getting a better ROI on wireless, but wireless can't provide the bandwidth and headroom homes and businesses require.

Verizon's residential LTE "HomeFusion" likely to serve only fringes of small number of metro areas

Verizon's announcement today of its HomeFusion wireless residential Internet service offering based on its nascent 4G cellular LTE service appears aimed at picking up marginal residential market share in suburban and exurban fringes of U.S metro areas where wireline connectivity from incumbent telcos and cable providers is sketchy. These are also areas where Verizon might otherwise deploy its FiOS fiber to the premise residential wireline product but will not because the company has called a halt to further FiOS expansion.

It's not likely HomeFusion will be broadly deployed in predominantly rural and quasi-rural areas. Like Verizon's mobile wireless offerings, it's bandwidth metered and can't offer the ample headroom for bandwidth demand growth -- much of it driven by video -- that fiber does. In order to improve Internet deployment and access in these areas, these communities will have to build their own fiber to the premises networks constructed by local governments or telecom cooperatives.

AT&T has effectively thrown in the towel in serving these areas. HomeFusion represents Verizon's last ditch effort to pick up some limited revenues in these underserved markets.

Verizon misses on price points for higher tier FiOS service

There are four key elements to a successful business offering: product, price, promotion and distribution channel. When it comes to the high end of its FiOS fiber to the premises (FTTP) Internet service, Verizon has most but not all of those elements.

The missing element? Price. At $200 a month for service providing downstream connectivity of 150 Mbit/s and 35 Mbit/s on the upside, "nobody's buying," reports Kathy Brown, Verizon's senior vice president for public policy according to this Light Reading story. Even in university towns, where Aspen Institute fellow and former government broadband policy guru Blair Levin wants to explore bringing gigabit service through his Gig.U project. Consumers, Brown notes, instead opt for cheaper service tiers providing connectivity at lower speeds.

Of course few are interested in buying Verizon's higher end service at $200 a month. That's an unacceptable price for most consumers. It's also an expected consequence of telco marketing strategy that rations bandwidth, creating an economic disincentive for customers to use more. Products and services cannot be successful when price points are set unrealistically high. It is also pointless to blame consumers for not buying when they are.

DSL reaches end of line as interim pre-fiber to the premises technology

Digital Subscriber Line (DSL) was deployed by telcos starting in the late 1990s as an interim technology to bring Internet Protocol-based telecommunications services to customer premises before fiber optic connections could be brought to them.

Now DSL faces a crisis that dramatically shortens the days it can play this role. While DSL allows telcos to use existing copper plant designed for Plain Old Telephone Service (POTS), that copper plant is aged and deteriorating quickly. DSL tends to work best over newer, more pristine copper. But there's not much of that (if any) being deployed these days. Meanwhile, DSL customers complain about connections that run slower than advertised or are prone to outages as DSL signals struggle across ancient pairs of twisted copper.

And since about 2008 and amid the current economic downturn, telcos have pared back their DSL rollouts. Verizon concentrated on fiber to the premises via its FiOS product offering, prompting customer complaints it was neglecting its copper plant and repairing it with bubble gum and duct tape.

Here's the crisis: Now that DSL has served its role as an interim IP solution on the road to fiber to the premises, the United States is not prepared to make the transition to fiber. Stunningly, this gap in the technology transition isn't addressed in the Federal Communications Commission's National Broadband Plan issued this past spring. Nor is there any indication the nation's two largest telcos are seriously addressing it. Verizon recently halted build out of its FiOS fiber plant. AT&T opted for a hybrid model of fiber to the node and copper to the premise for its U-Verse product. But the VDSL transmission technology that powers U-Verse suffers from far greater distance limitations than previous generations of DSL and greatly limits U-Verse's service footprint.

It will fall to smaller, locally owned and operated telcos, local governments and telecom cooperatives to pick up where DSL left off (or in many cases, left out for those not serviceable by DSL). The National Broadband Plan should recognize that DSL over copper is dead or dying and support efforts by these entities to deploy fiber to the premises with technical assistance grants and infrastructure construction grants and low cost loans.

The view from the UK: America's "lame" "costly" "third-world" telecom infrastructure

The Economist offers this critical perspective on America's "lame" "costly" "third-world" telecommunications infrastructure that combines the worst of all worlds with poor quality service at high cost compared to other advanced nations. But the dreary state of affairs isn't much better across the pond in the magazine's UK home base either. Just a few months ago, Prince Charles warned much of the British countryside is in danger of becoming a "broadband desert," hamstrung by an aging, latency copper wire infrastructure that can't deliver sufficient throughput to enough of the populace.

As Exhibit A of the U.S. broadband gap, the magazine pointed to the outpouring of supplications to Google urging the company to roll out its experimental 1 Gigabit fiber to the premises telecom infrastructure in their communities.

Much of the article goes on to repeat the same points made elsewhere about the flaws of the U.S. telecom paradigm and the sturm und drang industrialized nations are undergoing as they transition from legacy wireline single purpose systems designed to deliver voice and television signals to fiber optic infrastructures capable of providing multimedia and interactive applications using Internet protocol.

The article closes with a bit of wireless vaporware by suggesting Verizon is abandoning its FiOS fiber to the premises service in favor of Long Term Evolution (LTE) wireless service that could deliver 150Mbs. Perhaps over Starfleet Command's quantum sub-space channel. But not in today's world where people are literally jumping into freezing lakes in hopes of getting Google to deploy real state of the art fiber technology to their homes and businesses.

Municipalities, telco coops essential players in fiber to premises deployment

Verizon issued a news release Monday pointing to a study commissioned by the Fiber to the Home Council suggesting that once the U.S. housing market begins to thaw, homebuyers will be hot for fiber. Or as another study issued last November by Google described them, "Homes with Tails."

As the only telco committed to a full fiber to the premises strategy for both brownfields and greenfields with its FiOS product, Verizon clearly has an interest in promoting the concept. The problem is Verizon like other big telcos as well as cable companies have segmented their markets such that locales where fiber would be most the desirable real estate amenity -- such as those that are home to exurban and semi-rural telecommuters and small businesses -- are least likely to see it. The only way these places can expect to get fiber to the premises in the foreseeable future is to start municipal fiber projects and fiber telecommunications cooperatives.

Both types of entities are also good candidates for some of the $7.2 billion in broadband infrastructure subsidies contained in the American Recovery and Reinvestment Act signed into law in February as well as likely follow on funding promised by the Obama administration.

Misgivings in Maryland over Verizon FiOS reach

Charles County, Maryland commissioners are concerned a franchise deal the county is finalizing with Verizon to install Verizon's proprietary FiOS fiber optic cable in county rights of way won't serve the county's telecommunications needs.

SouthMdNews.com reports:

‘‘I want to know how we’re improving what we [have] now,” said commissioners’ President F. Wayne Cooper (D). He compared the pending Verizon deal to that of a builder making big promises in order to secure approval for a small project.

‘‘This sounds an awful lot like ‘let me build the retail now, and I’ll build the offices later.’”

Again, staff was reluctant to discuss the details of the Verizon agreement on the record. However, Rick Elrod, the county’s consultant for the Verizon deal, admitted that the Verizon project being discussed would not be as broad as the commissioners would like.


Sounds like the commissioners need to consider alternatives such as open access fiber lest they end up with angry constituents due to the limitations of the proposed Verizon FiOS project.

4G wireless broadband seen as potential game changing technology

Fourth generation (referred to as 4G or LTE--Long Term Evolution) wireless service expected to be deployed between 2010 and 2012 has the potential to be a game changer for IP-based advanced telecommunications services. The GSM Association (GSMA) predicts the technology will be able to provide 100 Mbps broadband connections, rivaling the throughput of fiber optic wireline services such as Verizon's FiOS, according to a report published this week in mobile news. The big questions of course are whether and when it can.

Blair Levin, an analyst with Stifel Nicolaus and a reportedly a rumored Federal Communications Commission nominee in an Obama administration, apparently thinks 4G will alter the playing field in broadband, telling this week's CoBank Communications Industry Executive Forum in Colorado that it has the potential to dramatically expand the cannibalization of wireline-based connections. That means people will not only ditch their voice landlines as they have in droves over the past few years, but also their cable and DSL-based broadband services since 4G's speeds will surpass these and at least approximate the 50Mbs throughput of pure fiber plays offered by Verizon, SureWest Communications and others.

But once again, 4G's broadband capabilities remain speculative and no one yet knows if 4G can really deliver on its potential and whether its costs can support a business model allowing it be be widely offered in the same footprint currently covered by existing 3G wireless services, which in some areas without wireline-based services is the sole terrestrial broadband option. Additionally, 4G must overcome the high latency that can render 3G connections decidedly less than snappy.

Meanwhile, the Sprint and Clearwire predict with expected regulatory approval by year end, their WiMAX rollout will leapfrog 3G and offer a technologically superior alternative with better range. Longer range translates into fewer transmission towers and lower latency.
Not only does WiMAX's longer range make it more suitable for less densely populated areas, it also reduces the need for fiber backhaul -- less widely available outside of metro areas -- since there will be fewer transmission sites to feed.

Looking ahead over the next several years, it appears likely the U.S. wireless broadband market will bifurcate with 4G/LTE-based systems run by the big telcos like AT&T and Verizon dominating in metro areas and WiMAX and WiMAX players such as Sprint/Clearwire taking control at the fringes and outside of metro areas.

Unusual competitive situation develops in the Big D: Verizon plans FiOS overbuild in areas served by AT&T U-Verse

Matt Stump at Onetrak reports Verizon is opting to go head to head with AT&T in the IPTV triple play market for about 60,000 customers in suburban Dallas.

The development is being seen by some such as Telecompetitor as possibly the opening salvo of a competitive war between the two big telco TV players in states such as Texas where the telcos have successfully lobbied for state video franchises. It's also likely a contest of IPTV technology with Verizon betting when it comes to delivering HDTV, it can clean AT&T's clock with its fiber to the home (FTTN) full fiber infrastructure compared to AT&T's hybrid fiber and copper cable VDSL-based plant delivering Ma Bell's U-Verse Internet/TV/phone bundle.

What's also interesting about this overbuild is there's also a cable provider in this same Dallas area, Time Warner Cable, that will now find itself competing not just with a single telco in the usual duopolistic market configuration, but with two.

Onetrak concludes Verizon's move could have significant implications for other states such as Florida, California, Indiana, Washington and Oregon where Verizon operates inside AT&T and Qwest territory.
